Terms of Service

These Terms govern your access to and use of the ZENAO mobile app, connected-device services, and related software and support.

1. Acceptance of these Terms

By creating an account, downloading the ZENAO app, or using the Services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services. “ZENAO,” “we,” “us,” and “our” refer to the operator of the ZENAO Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Services if applicable law prohibits you from doing so.

3. Your account

  • Provide accurate registration information and keep it current.
  • Keep your sign-in credentials confidential and notify us promptly of suspected unauthorized access.
  • You are responsible for activity conducted through your account, except to the extent caused by our breach of applicable obligations.
  • Do not create an account for another person without authorization.

You may request account deletion as described on our Account Deletion page. Deleting an account may permanently remove saved collections, device associations, sharing records, and other account data.

4. Connected devices and safe use

The app is designed to work with compatible ZENAO kinetic sand art devices. Availability and behavior may depend on device model, firmware, network conditions, region, and app version. Follow the product guide and all safety instructions supplied with your device.

  • Keep small metal balls and other small parts away from children and pets.
  • Do not operate, disassemble, modify, or service the device in an unsafe manner.
  • Keep the device powered and connected during firmware updates unless instructed otherwise.
  • You are responsible for the security and suitability of the Wi-Fi network used with the device.

5. License and acceptable use

Subject to these Terms, ZENAO grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and Services with compatible ZENAO products for lawful, non-commercial purposes.

You may not:

  • copy, sell, sublicense, distribute, or commercially exploit the Services except as law expressly permits;
  • reverse engineer, bypass security, probe, disrupt, or overload the Services or connected devices;
  • use another person’s account or device without authorization;
  • upload malicious code, unlawful content, or material that infringes another person’s rights;
  • use the Services to create a safety risk, violate law, or interfere with others; or
  • remove ownership notices or misrepresent your relationship with ZENAO.

6. Your content and feedback

You retain ownership of profile images, collection names, and other content you provide. You grant ZENAO a limited license to host, process, transmit, and display that content only as needed to operate, secure, and support the Services. You represent that you have the rights needed to provide the content.

If you provide ideas or feedback, we may use them without restriction or payment, provided we do not identify you publicly without permission.

7. Device sharing

If you invite another user to access a device, you are responsible for choosing the recipient and for revoking access when it is no longer appropriate. A shared user may be able to view device status and send supported commands. Do not share access with anyone you do not trust.

8. Updates and service changes

We may provide app or firmware updates, including updates needed for security, compatibility, or reliable operation. Some updates may be required to continue using the Services. We may modify, suspend, or discontinue features, but will provide notice where required by law.

9. Third-party services

The Services may use or link to third-party services, including Apple or Google sign-in. Those services are governed by their own terms and privacy policies. ZENAO is not responsible for a third party’s independent services or conduct.

10. Ownership

The Services, software, designs, trademarks, content supplied by ZENAO, and related intellectual property are owned by ZENAO or its licensors and are protected by applicable law. These Terms do not transfer ownership to you.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ZENAO DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR COMPATIBLE WITH EVERY DEVICE OR NETWORK.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENAO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM THE SERVICES.

To the maximum extent permitted by law, ZENAO’s aggregate liability arising from the Services will not exceed the greater of US$100 or the amount you paid directly to ZENAO for the Services during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create a security or legal risk, or use the Services unlawfully. Where appropriate, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive will remain effective after termination.

14. Disputes and applicable law

Before filing a formal claim, please contact support@zenao.art so we can try to resolve the issue. These Terms are governed by the laws that apply to the ZENAO service operator, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Courts with lawful jurisdiction may hear disputes unless the parties agree to another permitted process.

15. Changes and contact

We may update these Terms. The effective date shows when the latest version took effect. Continued use after an update becomes effective means you accept the revised Terms to the extent allowed by law.
